It is illegal to smoke on construction sites, and No Smoking signs must be posted at construction sites, demolition sites, and sidewalk sheds.

Smoking at any construction site (including demolition sites) is strictly prohibited. The Department of Buildings (DOB) will issue violations if it determines that workers or other individuals are smoking on job sites. 

Contractors must prominently display appropriate "No Smoking" signs on site. They must also remove ashtrays and inform anyone smoking on site to immediately extinguish any smoking materials. Contractors must then advise the smokers that they are not in compliance with City law and may be subject to fines and penalties.
