The Fairness in Apartment Rental Expenses (FARE) Act went into effect on June 11, 2025. This law prohibits brokers who represent landlords from charging broker fees to tenants. This includes brokers who publish listings with the landlord’s permission. Landlords or their agents must disclose other fees that the tenant must pay in their listings and rental agreements.

The Department of Consumer and Worker Protection (DCWP) enforces this law.

You can file a complaint against a landlord or real estate agent that:

  • Charges prospective tenants a broker fee when not hired by the tenant
  • Requires prospective tenants to use an agent
  • Lists a broker fee
  • Does not disclose fees or surcharges

What Happens Next

If you don't include your address or email with your Service Request, you won't receive follow up. The Department of Consumer and Worker Protection (DCWP) will consider your complaint a tip.

If you include your address, DCWP will mail you a complaint form. You must complete and return it to DCWP. If you provide your email address, you'll get the form by email instead. Check your spam folder if you don't see it in your inbox.
